terms of service

1. acceptance of terms

by accessing or using claire.im, you agree to be bound by these terms of service. if you do not agree, please do not use the service. these terms apply to all users of claire.im, including free and paid subscribers. serendipiware reserves the right to update these terms at any time. continued use of the service after changes constitutes acceptance of the updated terms.

2. who can use claire

you must be at least 16 years old to use claire.im. by using the service, you confirm that you meet this age requirement. if we discover that a user is under 16, their account will be deleted immediately. claire is intended for personal, non-commercial use only.

3. accounts

you need an account to use claire. you are responsible for maintaining the security of your account and for all activity that occurs under it. we use email-based one-time codes for authentication — no passwords are stored. you may only create one account per person. impersonating another person or entity is prohibited.

4. acceptable use

you agree not to use claire.im to:

• generate, share, or solicit illegal content of any kind.
• produce or distribute content that sexualizes minors in any way.
• harass, threaten, or harm other people.
• attempt to manipulate, jailbreak, or extract the system prompt or internal instructions from claire.
• use the service for automated or bulk requests (bots, scrapers, etc.).
• attempt to reverse-engineer, copy, or resell the service or its outputs commercially.
• circumvent any technical limitations or rate limits in place.
• use claire as a substitute for professional medical, legal, or psychological advice in situations requiring it.

violations may result in an immediate and permanent suspension of your account without prior warning, at serendipiware's sole discretion.

5. moderation

claire has the ability to mute or ban users who violate these terms. mutes are temporary and expire automatically. bans are permanent and may be applied for serious or repeated violations. if you believe your account was suspended in error, you can contact us at [email protected] to appeal. we do not guarantee reinstatement. banned accounts are not eligible for account deletion until the review period has passed, in order to preserve evidence of violations.

6. subscriptions and payments

claire offers a free tier with a daily message limit and a pro plan billed monthly. all payments are processed by polar.sh and stripe. by subscribing, you agree to their respective terms of service. subscriptions renew automatically each billing period. you may cancel at any time via the subscription management portal — your access continues until the end of the current billing period. we do not offer refunds for partial billing periods, except where required by applicable law (including EU consumer rights regulations).

7. free tier limits

free tier users are subject to a daily message limit which resets at midnight (athens time, UTC+2). this limit may change over time. serendipiware reserves the right to modify, suspend, or discontinue the free tier at any time with reasonable notice.

8. intellectual property

claire, the serendipiware brand, and all associated software, designs, and content are the property of serendipiware. you may not reproduce, copy, or distribute any part of the service without explicit written permission. the content of your conversations belongs to you — we do not claim ownership over what you write. however, by using the service you grant serendipiware a limited license to process your messages solely for the purpose of generating responses and maintaining your experience.

9. disclaimers

claire is an AI companion and is not a licensed therapist, counselor, or medical professional. nothing claire says should be treated as professional medical, psychological, or legal advice. if you are experiencing a mental health crisis, please contact a qualified professional or a crisis helpline in your country. claire.im is provided "as is" without warranties of any kind. serendipiware does not guarantee uninterrupted or error-free service.

10. limitation of liability

to the fullest extent permitted by applicable law, serendipiware shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of claire.im. our total liability to you for any claim arising from use of the service shall not exceed the amount you paid to serendipiware in the 12 months preceding the claim.

11. governing law

these terms are governed by the laws of greece and the european union. any disputes shall be subject to the exclusive jurisdiction of the courts of patras, greece, unless otherwise required by applicable consumer protection law in your country of residence.
